Deputies entered the apartment and located the victim, Owen Higginbotham, 39 years old of Jefferson, WV. He was bleeding from cuts to his face and left arm. The injuries made communications difficult. As he was walked outside to safety he explained the person who cut him was still inside. He told the Deputy Sheriffs his attacker was his cousin, later identified as Howard Justice, 39 years old of Jefferson, WV.
As Corporal Vernon and Deputy Smith reentered the apartment they saw more blood on furniture and the floor. They located Mr. Justice in a back bedroom. He refused to come out. As the Deputy Sheriffs opened the bedroom door Mr. Justice jumped up, but complied with their commands and was detained without injury to himself or the Deputy Sheriffs.
The scene was photographed, statements were taken, and evidence collected. The knife used was a kitchen/paring knife and had a four inch blade.
Mr. Higginbotham was taken from the scene by ambulance to an area hospital for treatment to his injuries. The injuries are not believed to be life-threatening.
The two were arguing about a vehicle when violence broke out. Mr. Higginbotham said Mr. Justice tried to stab him in the chest, but he raised his arm to block the knife, resulting in the cut to his left arm.
Mr. Justice was arrested and charged with malicious wounding, a felony. He was taken to Kanawha County Magistrate Court where his bond was set at $50,000.00, then to South Central Regional Jail.
As is always the case in criminal matters, the charge against Mr. Justice is merely an accusation. He is presumed innocent unless and until proven guilty.
