December 29, 2015: Arrest of Felon with Gun

On the evening of December 28, 2015 Corporal T. A. Fouch of the Kanawha County Sheriff’s Office was dispatched by Metro 911 to Smiley’s Motel in Jefferson, WV.  The management reported a female trespasser in a second story room.  When Corporal Fouch arrived with his partner, Corporal J. W. Eary, they went to the room and found the alleged female trespasser and an adult male. 

 

The male opened the door and stepped out to talk to Cpl. Eary, then ran from him.  While running the man removed a black handgun from the front of his pants.  He ran downstairs, across the parking lot, across U.S. Route 60 and into a wooded area near the railroad tracks where he threw the handgun.  Deputies crossing the roadway in pursuit said they were almost struck by cars.  The male stumbled to the ground as Cpl. Fouch neared him, but he would not place his hands behind his back.  Instead he got up to run again and Cpl. Fouch used a Taser, then handcuffed the man.

 

The man was identified as Timothy Lee Leftenant, 36 years old of Charleston, WV.  A check of his criminal history revealed he was on federal probation from a conviction in Ohio relating to weapons and drug offenses in 2009.  He also was convicted of domestic violence in Kanawha County in 2008.  He was charged with being a prohibited person in possession of a firearm.

 

Additional misdemeanors stemming from this incident may be later charged against Mr. Leftenant.  As is always the case in criminal matters, last night’s complaint against Mr. Leftenant is merely an accusation.  He is presumed innocent unless and until proven guilty.  Attached is a mug shot taken during his arrest.
